RE: FLEXION LIFESTYLE CONSULTANTS

BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.  PLEASE READ CAREFULLY.

ASSUMPTION OF RISKS, WAIVER OF CLAIMS AND RELEASE OF LIABILITY

WHEREAS MIRANDA LIN REECE, operating as sole proprietor having the name: RE:FLEXION LIFESTYLE CONSULTANTS ( “Re:Flexion”) are prepared to allow me to participate in triathlon clinics and/or races involving swimming, biking and/or running, as well as Pilates exercise programs (the “Activities”) at various locations in the Lower Mainland of British Columbia;
AND WHEREAS I wish to participate in the Activities;
ASSUMPTION 0F RISKS
I ACKNOWLEDGE the hazardous nature of triathlon clinics, participating in the Activities and being present among others who are also participating in the Activities.  I am aware that participating in the Activities involves many inherent risks, dangers and hazards, including but not limited to: tire punctures and other bicycle or equipment-related failures, impact or collision with other participants; crashes; falls; drowning, hypothermia, heat exhaustion and other hazards not listed in this document.
I know that risks, dangers and hazards exist whenever the Activities occur and that many of these risks, dangers and hazards are not obvious or apparent.  I am also aware that despite Re:Flexion having established rules for the Activities to which all participants in the clinics must adhere, other participants act unexpectedly at times and may break those rules.  There may be negligence on the part of other participants.  I FREELY ASSUME ALL OF THOSE RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH AND PROPERTY LOSS OR DAMAGE WHICH MAY RESULT FROM THOSE HAZARDS.
WAIVER OF CLAIMS AND RELEASE OF LIABILITY
In consideration of Re:Flexion permitting me to participate in the Activities, I agree:
1.	TO WAIVE ALL CLAIMS FOR DAMAGES OF ANY SORT I have or may in the future have against:
(b) Re:Flexion clinics, consisting of  Miranda Lin Reece; and its affiliates, its directors, shareholders, officers, members, employees, instructors, assistants, agents and representatives;
(c) The Nike Stores, operated by the licensee New Age Sports Inc., The Nike Store (Kerrisdale), New Age Sports Inc. its directors, shareholders, officers, members, employees, instructors, assistants, agents and representatives  Paul Dusanj and Ruby Dusanj.
(d)  Nike Canada Ltd, and its affiliates, its directors, shareholders, officers, members, employees, instructors, assistants, agents and representatives;
(e) BFLP LadySport limited, and its affiliates, directors, shareholders, officers, members, employees, instructors, assistants, agents and representatives.
(f) The University of British Columbia , its directors, shareholders, officers, members, employees, instructors, assistants, agents and representative;
(g) Powerbar Foods Ltd., and its affiliates, its directors, shareholders, officers, members, employees, instructors, assistants, agents and representatives;
(h) The Greater Vancouver Regional District; and department of highways
(i) BC Athletics and its affiliates, its directors, officers, members, employees, instructors, assistants, agents and representatives;
(j) Triathlon BC and its affiliates, its directors, officers, members, employees, instructors, assistants, agents and representatives;
(k) The City of Vancouver and Vancouver Board of Parks and recreation/and or Vancouver Police Board, their officers agents, employees and volunteers.
(l) Ron Andrews Recreation Center
(m) The Municipalities of North Vancouver and Deep Cove; The District of North Vancouver and it’s department highways
(n) The Musqueam Indian Band; and
(o) Any other organization, body corporate, municipality, or individual which hosts any of the Activities in conjunction with Re:Flexion.
(collectively, the “Releasees”).
2.	TO RELEASE THE RELEASEES from all liability for any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer, as a result of me participating in the Activities due to any cause whatsoever, INCLUDING NEGLIGENCE, BREACH OF CONTRACT AND BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1996, c.337 ON THE PART OF THE RELEASEES;
This agreement will be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity.
In entering into this agreement, I am not relying upon any oral or written representations or statements made by the Releasees other than what is set forth in this agreement.
WARNING:	Any participant with known and unknown physical conditions that may be aggravated by participation in any of the Activities (examples: epilepsy, heart conditions, joint problems, a state of poor physical fitness, etc.) should check with their physicians before participating in the Activities.  The Releasees are not responsible for pre-event screening of participants and/or injuries incurred during participation in the Activities.

PARENT ACKNOWLEDGEMENT, WAIVER OF CLAIMS,
RELEASE OF LIABILITY AND INDEMNITY
I/We, 						 and 						 the parents/guardian of 					 (my “child”), in consideration of Re:Flexion permitting my child to participate in the Activities, agree as follows:
1.	I/WE ACKNOWLEDGE that I/we have read and understood fully the above Assumption of Risks, Release of Liability and Waiver of Claims and have explained to my child the consequences of signing it;
2.	I/WE WAIVE ALL CLAIMS I/we have or may in the future have against the Releasees;
3.	I/WE RELEASE THE RELEASEES from all liability for any loss, damage, injury or expense that I/we may suffer as a result of my/our child participating in the Activities due to any cause whatsoever, INCLUDING NEGLIGENCE, BREACH OF CONTRACT AND BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1996, c.337 ON THE PART OF THE RELEASEES;
4.	I/WE WILL HOLD HARMLESS AND INDEMNIFY THE RELEASEES from all liability respecting all claims that may be brought by my/our child as a result of my child participating in the Activities, INCLUDING CLAIMS ALLEGING NEGLIGENCE, BREACH OF CONTRACT AND BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1996, c.337 ON THE PART OF THE RELEASEES;

I HAVE READ AND UNDERSTOOD THE ABOVE prior to agreeing to it, and I am aware that by selecting the checkbox I agree to this document I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators or assigns may have against the Releasees.

NOTE: ALL RACE FEES ARE NON-REFUNDABLE OR NON-TRANSFERABLE THIS INCLUDES RACE CANCELLATION DUE TO ANY ACT OF GOD OR FORCE MAJEURE, INCLUDING, WITHOUT LIMITATION, WEATHER, FIRE, FLOOD, STRIKE, LABOUR DISPUTE, CIVIL COMMOTION, RIOT OR THREAT, OR SIMILAR CAUSE BEYOND THE CONTROL OF RE:FLEXION LIFESTYLE CONSULTING.
